The Space for Expatriates

We just purchased a condo, a penthouse with private rooftop. OUr plans included

to build an outdoor kitchen/bar and a palapa over it. We obtained verbal ok from the

homeowners association in regards to our project. Now somebody stopped the construction

of the palapa because of height issues. Some condo owners have palapas, some don't.

Any body knows the laws in Playa del Carmen? And if we continue building a palapa higher

than the other condo owners would like, what can happen? Any legal consequences in Mexico

and Playa del Carmen?

Congradulations on your new condo! Sounds like you have some great Ideas for your new place. Your first step in getting approval from the Homeowners Association was correct, though you will still need approval for your construction from the city. You will need to provide the all the details regarding your project and get approval to build from them. There are height restrictions for your Palapa. As you are probably fully aware, there are often many ways to get things acomplished here in Mexico, unknowingly often times not following established laws and regulations can result in large fines and/or your project being haulted until matters are cleared up, in the end costing you time, frustration and additional money. We have helped many clients through this process, feel free to contact me if you would like some additional guidance, we have a very skilled staff familiar with the process.
